TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over who are franchisees, proprietors, managers or employees of retailers and attend the C-Store/ Forecourt 2008 trade event in Melbourne, VIC. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Each entry badge can only be scanned once.
5. The C-Store/ Forecourt 2008 trade event will be held over 24/07/08 and 25/07/08 inclusive. There will be 5 minor draws each day of the trade event and 1 major prize draw on the final day of the event. Entries close for each draw on the dates and times specified in the table below. All draws will take place at the organiser’s offi ce at the C-Store/ Forecourt 2008 trade event, Melbourne Exhibition Centre, 2 Clarendon Street Southbank Victoria 3006 on the dates and times specified in the table below. All times indicated are AEDST unless specified otherwise Un-drawn entries in each minor draw will be entered into any subsequent minor draws and all entries (including winners in a minor draw) will be entered into the major prize draw. Winners will be notifi ed by mail and the winners’ names will be published in The Australian Convenience Store News on 15/08/08 (in the case of Victorian winners, names will be published in The Age on 15/08/08). The Promoter’s decision is final and no correspondence will be entered into.
6. The first valid entry drawn in Draws 1 through to 10 will each win Campbells Wholesale credit for their retailer valued at $1000.
7. The first valid entry drawn in the Major Prize Draw will win a Suzuki SX4 4WD Hatch with automatic transmission, metallic paint and roof racks. Total prize value is up to AU$30,000 including all compulsory insurance and on-road costs (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion, accommodate the winner’s colour preference, subject to availability. The winner must collect the prize from their nearest authorised Suzuki dealership. Major Prize winner will also receive a $2000 voucher for their choice of (a) boating, fishing or camping equipment from BCF; or (b) golfing equipment from Drummond Golf; Total Major prize value is up to $32,000.
8. Any ancillary costs associated with redeeming the Campbells wholesale credit or voucher is not included. Any unused balance of the credit or voucher will not be awarded as cash. Redemption of the credit or voucher is subject to any terms and conditions of the issuer.
9. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
10. Total prize pool value is up to $42,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
11. A draw for any unclaimed prizes may take place on 01/12/08 at Suite 6, The Atrium, 340 Darling Street Balmain 2041 at 12 noon AEST, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian Convenience Store News on 10/12/08 (in the case of Victorian winners, names will be published in The Age on 10/12/08.
12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
13. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the C-Store/ Forecourt 2008 trade event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.
14. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
